In-N-Out Lawsuit Against Doordash: What’s This All About

In-N-Out is suing the popular food delivery service DoorDash for lack of trust in their delivery service. In-N-Out just doesn't want to be affiliated with DoorDash.

While DoorDash delivers food and has deals with major restaurants, In-N-Out doesn't want its name linked with the startup delivery company. Because of this, the popular west coast burger chain is suing DoorDash saying that they're worried about losing control over the time that DoorDash takes in order to deliver their food.

In-N-Out said that they have also repeatedly asked DoorDash to stop selling their food. In addition, as per TMZ, DoorDash has been using an imitation In-N-Out Burger logo on their website, even though In-N-Out has denied them permission repeatedly.

"We have asked DoorDash several times to stop using our trademarks and to stop selling our food," Arnie Wensinger, the restaurant's general counsel, told CNBC via email.

"Unfortunately, they have continued to prominently use our trademarks and serve our food to customers who believe that we are responsible for their delivery. Prior to filing the lawsuit, we tried contacting them several more times but they never responded to our phone calls or letters," he added.

Wensinger also noted that the way DoorDash uses their food and trademarks imposes a partnership between the two. Clearly, that is not the case as In-N-Out doesn't want anything to do with the delivery company.

According to CNBC, DoorDash services more than 250 cities in the U.S. Its big food name partners include 7-Eleven and Taco Bell.

CNBC recently asked DoorDash to comment on the In-N-Out lawsuit.

"DoorDash uses its innovative logistics technology to deliver the very best food and products in neighborhoods across the country. While we have various relationships with different merchants, we are proud to help people get their favorite food delivered directly to their door," a DoorDash representative told the news station.

In a Food Beast report, the reporter has used DoorDash service twice, and one experience was quite unsatisfactory. The reporter's first time using the DoorDash service was a success, since his food arrived less than 40 minutes after the order. However, the second one took roughly an hour and 15 minutes.

In-N-Out is reportedly meticulous about their quality control, as seen in this Monkey Style video.

Apparently, several New York-based eateries are also not on good terms with the services of DoorDash. According to Eater,

Manhattan and Brooklyn eateries are livid at DoorDash because they up-charge customers in the area. According to a cheesesteak shop in Brooklyn, his sandwiches sell at $11, but DoorDash charges their customers $16.95 for the snack.

There has been no update about the In-N-Out lawsuit against DoorDash as of this writing. In-N-Out is suing DoorDas for damages as well as the removal of the In-N-Out logo from the DoorDash app.
